Terms of Use

These Terms of Use (“Terms”) are an agreement between you and TrueSummit (“TrueSummit,” “we,” “us”) governing your use of the TrueSummit app and related services (the “App”). By downloading or using the App, you agree to these Terms. If you don’t agree, don’t use the App. Your use of the App is also subject to our Privacy Policy.

The App is a tool, not financial advice

TrueSummit is a personal budgeting and net-worth tracking tool. It does not provide financial, investment, tax, legal, or accounting advice, and nothing in the App is a recommendation to take any particular financial action. Forecasts, projections, debt-payoff plans, and insights are estimates based on the data you provide or connect, and may be inaccurate or incomplete. You are solely responsible for your financial decisions. Consult a qualified professional before making decisions that carry financial consequences.

Your account and your data

You are responsible for keeping your account credentials and device secure, and for all activity under your account. You must provide accurate information and be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. You retain ownership of the financial data you enter or connect; you grant us only the limited rights needed to operate features you use, such as cloud sync and household sharing, as described in our Privacy Policy.

Bank connections and third-party data

If you link a financial institution through Plaid, or import Apple Card, Apple Cash, and Savings activity through Apple’s FinanceKit, that data is provided by those third parties and their institutions. We don’t control its accuracy, availability, or timeliness, and connections may be interrupted or discontinued by those providers. Your use of Plaid is also subject to Plaid’s own terms.

Subscriptions and billing

TrueSummit offers a 30-day free trial followed by auto-renewable subscriptions (TrueSummit Pro and TrueSummit Premium). After any free trial ends, continued use of the App requires an active subscription.

  • Payment is charged to your Apple Account at confirmation of purchase.
  • Subscriptions automatically renew for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
  • You can manage or cancel your subscription in your Apple Account settings; cancellation takes effect at the end of the current billing period.
  • Any unused portion of a free trial is forfeited when you purchase a subscription.
  • Purchases and renewals are processed by Apple. Refunds are handled by Apple in accordance with its policies; we generally cannot issue refunds directly.

Prices may change; we will give notice where required, and any change applies only to future billing periods.

Acceptable use

You agree not to misuse the App. In particular, you will not: reverse engineer, decompile, or attempt to extract source code except as permitted by law; interfere with or disrupt the service or its security; access it through unauthorized means; resell or commercially redistribute it; or use it to violate any law or the rights of others.

Availability and changes

We may add, change, suspend, or discontinue features at any time, and we may update the App. We aim to keep the service running but do not guarantee it will be uninterrupted or error-free.

Disclaimers

To the maximum extent permitted by law, the App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will meet your requirements or that calculations, forecasts, or synced data will be accurate or error-free.

Limitation of liability

To the maximum extent permitted by law, TrueSummit will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or financial outcomes arising from your use of, or inability to use, the App. To the extent liability cannot be excluded, our total liability is limited to the amount you paid for the App in the twelve months before the event giving rise to the claim.

Termination

You may stop using the App at any time and delete it. We may suspend or terminate your access if you breach these Terms or use the App in a way that could harm us, other users, or third parties. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and the governing-law terms) will survive.

Apple App Store terms

The following applies to the version of the App obtained through the Apple App Store:

  • These Terms are between you and TrueSummit only, not with Apple. Apple is not responsible for the App or its content.
  • Your license to use the App is a non-transferable license to use it on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for the App.
  • To the extent any warranty is not effectively disclaimed, Apple may refund the purchase price (if any); beyond that, Apple has no warranty obligation, and any claims relating to the App are our responsibility, not Apple’s.
  • Apple is not responsible for addressing product-liability claims, third-party intellectual-property claims, or claims that the App fails to conform to legal requirements.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Governing law

These Terms are governed by the laws of the United States and the State of Utah, without regard to conflict-of-laws rules, except where mandatory local consumer-protection law applies to you.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above and, where appropriate, noted in the App. Continued use after changes take effect means you accept the revised Terms.
